Terms and Conditions
These Terms and Conditions govern your access to and use of the Apex Karting website and any requests, bookings, estimates, race sessions, events and related interactions under the Apex Karting name. By visiting the website, submitting a race request, accepting a quote, signing a waiver, taking a briefing or driving a kart, you agree to these Terms. If you do not agree, do not use the website or request sessions. Apex Karting is a high-energy indoor karting experience built for speed, competition, and fun, based at 105 N 3rd St, Bushton, KS 67427, United States.
Whether you’re racing with friends, celebrating a special event, or chasing your fastest lap, our track delivers exciting action for drivers of all skill levels. Website information is general and does not guarantee a grid slot for every date, group size, weather-related closure or kart class. A submitted request is not a confirmed booking until Apex Karting accepts it and communicates session details. We may request additional information, driver ages, waiver names, group notes or a deposit before confirming format, price, duration or timing.
1. Authority and Eligibility
You confirm that you are legally able to enter an agreement and that information you provide is accurate. If you book for another person, family, employer or event group, you confirm authority to arrange attendance and authorise racing by the named drivers. You must be at least eighteen years of age to submit a booking and accept payment responsibility, unless a parent or legal guardian books for a minor and remains present. Drivers must meet posted height, age and waiver rules for the kart class assigned. Closed-toe shoes are required.
2. Services and Limitations
Services may include arrive-and-drive heats, grand prix formats, junior sessions, birthday packages, corporate cups, league rounds, extra heats, trophies and photography where offered. Availability depends on staffing, karts, track condition, group size and scheduling. Descriptions, images, lap times and pricing guidance are informational. Results vary with driver skill, kart class, traffic, flags, mechanical issues and session length. We do not guarantee a personal best, a win, or that every historic lap record can be beaten in a limited heat.
Off-track coaching beyond the standard briefing, private testing, mechanical instruction, alcohol service, lodging and third-party entertainment may be excluded unless expressly agreed in writing. Apex Karting is an indoor recreational racing venue, not a licensed motorsport sanctioning body. We may decline or stop a session that cannot be run safely, that would risk damaging karts, or that would require drivers who fail the briefing, waiver or fit check. Intoxication, aggressive driving after a warning, or refusal to follow flags may end a driver’s session immediately.
3. Estimates, Pricing and Payment
Estimates may be based on customer information, group size and expected track time. An estimate is not a fixed final price unless expressly confirmed as such. If actual headcount, ages, extras or requested format differ from the description, we may revise scope, duration or price before continuing. Prices may reflect time, kart class, driver count, extras and frequency. Additional charges may apply for extra heats, late arrivals, unused reserved karts, waiting time, private hire or tasks outside the original estimate.
Payment is due according to terms communicated at booking. The person who books remains responsible for payment unless another arrangement is accepted in writing. Deposits may be required for larger events or league programmes. Failed or unpaid amounts may lead to suspension of future bookings and recovery of the outstanding balance together with reasonable administration costs. Promotional rates apply only to the package described at the time of booking.
4. Customer Responsibilities
Customers must arrive in time for check-in, complete waivers, disclose conditions affecting safety, control spectators and follow marshal instructions, including flags, speed, bumping rules and kart-return procedures. Entry must be available at the agreed time. We are not responsible for delays caused by late groups, incomplete waivers, missing drivers or parking issues. Valuables should not be left in karts or unattended in the paddock. Supervise children in spectator areas. Drivers must tell us about recent injuries, pregnancy, or medical conditions that make racing unwise before they sit in a kart.
5. Results, Cancellations and Conduct
Apex Karting works carefully to deliver fair racing, working karts and timed sessions. Racing may reveal that a driver needs more briefing time, a different kart class, or a rest after a spin. An arrive-and-drive heat is not a grand prix, private hire or championship round unless that enhanced format was booked and confirmed. Temporary red flags, kart swaps or shortened heats may be required for safety; we will explain practical arrangements where possible.
Provide reasonable cancellation notice. Late or same-day cancellations may incur fees where permitted to cover reserved track time, labour and prepared karts. Missed arrival may be treated as a missed session. Apex Karting may cancel or reschedule due to staffing, mechanical issues, unsafe track conditions or emergencies. Harassment or unsafe conduct toward staff, drivers or spectators is not tolerated and may end the session immediately, with payment still due for reserved time and racing already delivered.
6. Liability and Changes
Indoor karting involves inherent risk of collision, spin, strain and property damage. To the maximum extent permitted by law, Apex Karting is not liable for indirect, incidental, special or consequential losses from website use, delays, missed sessions, third-party decisions or race outcomes beyond our reasonable control. Nothing excludes liability that cannot lawfully be limited under applicable consumer law. Where liability may be limited, it may be capped at the amount paid for the relevant session. Mandatory consumer rights remain available. Waivers do not replace those rights where the law forbids it.
Customers should raise obvious concerns before leaving the venue where practical. Pre-existing injuries, spectator incidents outside our control, and damage caused after a driver ignores flags remain the customer’s responsibility where the law allows. Apex Karting may update these Terms to reflect service, operational, safety or legal changes. The updated version applies when published on the website.
