DMCA Copyright Policy

Apex Karting respects intellectual property rights and expects visitors, customers, contributors, contractors and other parties using this website to do the same. This policy explains how we handle allegations that content on or through the website infringes copyright. It sets out a fair process for reporting material, reviewing complaints, responding to valid removal requests and accepting counter notifications when removal was based on mistake or misidentification. Apex Karting is a high-energy indoor karting experience built for speed, competition, and fun, based at 105 N 3rd St, Bushton, KS 67427, United States.

Apex Karting does not knowingly publish or distribute material that unlawfully infringes copyright. When we receive a sufficiently detailed and valid notice, we may investigate and take appropriate action under the Digital Millennium Copyright Act where it applies, applicable copyright law, contracts and website rules. Covered material may include text, photographs, race images, graphics, layouts, logos and customer-submitted content related to indoor karting, gallery examples and company branding.

1. Purpose and Scope

Copyright owners and authorised representatives may notify Apex Karting about material they reasonably believe infringes a protected work. Affected parties may challenge removal through a counter notification when they believe the complaint was incorrect or based on misunderstanding of ownership, licence, public-domain status or fair use. This policy applies to content made available through the Apex Karting website. It does not automatically cover material hosted only on unrelated third-party sites. Complaints should identify protected expression, not mere ideas, methods, common phrases or general karting industry concepts such as indoor racing, lap timing or birthday events as topics.

United States copyright law and, where relevant, the DMCA process may inform how a notice is reviewed. Apex Karting is a recreational racing venue, not a court.

2. Website Content and Third-Party Rights

Original Apex Karting content may be protected by copyright, including service descriptions, educational resources, photographs, graphics and layouts. Visibility online does not place material in the public domain. Do not copy, republish, sell, scrape or commercially exploit website content without permission. Some materials may be used under licence and ownership may remain with creators or licensors. Copyright protects expression, not ordinary ideas or industry facts. Notices should not be used to suppress lawful criticism, factual reporting or independent commentary about indoor karting in Kansas.

The Apex Karting name, logo and distinctive layout may also be protected as branding elements. Other karting venues may still describe ordinary services in ordinary language. Similarity of common racing phrases alone does not prove copying.

3. Who May Submit and What a Notice Must Include

Only the copyright owner or an authorised agent should submit a notice. Before sending, confirm the material is on this website, compare it with the original work and verify ownership or licence status. A useful notice identifies the sender, the protected work, the allegedly infringing material and its location, and the action requested. Include identification of the copyrighted work, identification of the disputed material with enough detail to locate it, contact information for the reporting party, a good-faith statement that the use is not authorised by the owner, agent or law, a statement that the information is accurate and that the sender is the owner or authorised to act under penalty of perjury where required, and a physical or electronic signature.

Incomplete notices may be delayed, limited, rejected or returned for correction before further action is taken. Please write in English where possible and include a telephone number or email address we can use during ordinary business hours. If you are reporting a photograph, describe the original capture and the page on this website where the copy appears.

4. Review and Possible Actions

We may review whether the notice identifies a recognisable work, locates website material, contains required statements and comes from an eligible party. We may check records, source files, licences and contributor information. Apex Karting is not a court and administrative removal decisions do not finally determine legal ownership. We may remove, disable, restrict, replace, edit or unpublish material and may notify the content provider. Temporary restriction is not a finding of infringement and removal is not an admission of liability.

We may decline invalid, incomplete, fraudulent, overbroad or unsupported notices, or notices about material we do not control. Where material is licensed stock photography used for karting illustration, we may verify licence records before responding. Notices that try to control a customer review or a generic racing method that is not original to the complainant may also be declined.

5. Counter Notification and Restoration

If your material was removed, you may submit a counter notification only if you have a good-faith belief that removal resulted from mistake or misidentification. Identify the removed material and former location, state under penalty of perjury where required that removal was mistaken, provide accurate identifying information, include required jurisdiction and service-of-process statements, and sign the notice. We may forward a complete counter notice to the original complainant and may restore material after the applicable waiting period if we do not receive notice of timely court action. Restoration is not automatic and does not declare the material non-infringing.

A counter notice should not be used to keep clearly copied material online. If you created the photograph or hold a licence, explain that clearly.

6. Abuse, Exceptions and Contact

Repeat infringers may lose submission privileges or content relationships. False or abusive notices and counter notices may lead to rejection and possible legal consequences. Fair use and other exceptions may apply depending on facts. Licensed stock or commissioned work may be lawful even without visible credit. Ownership of a kart that was raced does not equal ownership of a photograph of that kart taken by another person. Similar ordinary racing photos or common motorsport phrases alone do not prove copying. We may keep records of complaints and actions for compliance and dispute management.
